Terms of Service

1. Definitions
- Service: the InboxServe platform, including all software, features, APIs, and documentation.
- User: any person who creates an account and/or uses the Service.
- Organization: the entity on whose behalf the User uses the Service.
- End Customer: a customer of the Organization whose data is processed via the Service.
- Provider: InboxServe B.V., registered in The Netherlands.
2. Applicability
- These Terms apply to all use of the Service.
- By creating an Account, the User accepts these Terms.
- Material changes will be communicated 30 days in advance.
3. Account and Registration
- Users must provide accurate and complete information.
- Users are responsible for keeping credentials confidential.
- The Provider may suspend accounts that violate these terms.
4. Service Delivery
- The Service is provided as SaaS for managing customer communication and related processes.
- The Provider aims for 24/7 availability but does not guarantee uninterrupted service.
- The Service is provided “as is” without warranties regarding specific results.
5. Acceptable Use
Users agree not to: violate applicable laws, send spam, overload or hack the Service, infringe intellectual property rights, or process personal data without a valid legal basis.
6. Intellectual Property
All IP rights to the Service belong to the Provider. Users retain rights to their Content and grant a limited processing license.
7. Data Protection
The Provider processes data per the GDPR and our Privacy Policy. Organizations remain data controllers for End Customer data.
8. Payments and Pricing
- Prices are displayed on the website. All prices exclude VAT unless stated otherwise.
- Payment is due in advance on a monthly or annual basis.
- The Provider may change prices with 30 days notice.
9. Term and Termination
- Subscriptions renew automatically unless canceled.
- Users may cancel at any time; cancellation takes effect at period end.
- Content is available for export for 30 days after termination.
10. Liability
- Total liability is limited to fees paid in the preceding 12 months (max €10,000).
- The Provider is not liable for indirect or consequential damages.
11. Governing Law
These Terms are governed by the laws of the Netherlands. Disputes are submitted to the competent Dutch court.
